The framework for our work: quotes, prices, deadlines, sign-off, usage rights and ownership of the work produced. Written to be read, not endured.
This is a courtesy translation, provided so that you can understand our terms. MEUS PRODUCTION is a French business and these documents are governed by French law: in the event of any discrepancy, only the French version is legally binding.
1. Purpose
These terms and conditions of sale (hereafter « the Terms ») govern the contractual relationship between MEUS PRODUCTION and its clients, for all the design, production and service work offered on this site.
Any order implies unreserved acceptance of these Terms. They prevail over any purchasing conditions of the client, unless otherwise agreed in writing. The signed quote and its appendices complete these Terms: in the event of contradiction, the specific provisions of the quote prevail.
The applicable version is the one in force on the date the quote is signed. The Terms may be amended at any time, with no effect on orders already confirmed.

3. Services offered
Prestations de production audiovisuelle, photographie, création graphique et production de contenus numériques.
The services offered fall within the following areas, set out in detail on the Services page:
- brand identity, logo design and brand systems
- graphic design and printed material
- website design and development
- design for social media
- photography
- video, film production and editing
- content creation
- event coverage
Downloadable digital resources and monthly support plans are also offered for sale, as described on the corresponding pages.
The exact content of each service, its deliverables and its scope are defined in the quote. Anything not mentioned in the quote is not included.
4. Quotes and orders
4.1 Request and preparation of the quote
Every enquiry gives rise to a detailed, free quote setting out the nature of the services, the deliverables, the price and indicative deadlines. The online simulator provides an indicative estimate which in no way constitutes a firm offer.
4.2 Validity
Unless stated otherwise on the document, the quote is valid for 30 days from its date of issue. After that, pricing may be reviewed.
4.3 Acceptance and confirmation of the order
The order becomes firm and final on two conditions: written acceptance of the quote by the client - signature or approval from the client portal - and payment of the deposit provided for in article 4.4.
4.4 Deposit
A deposit of 50% of the total amount is requested when the quote is accepted. It starts the project and reserves the production dates. A different schedule may be agreed in writing, in particular for long projects.
5. Prices
Prices are expressed in euros. Those set out in the quote are firm for its whole period of validity.
5.1 VAT
Franchise en base de TVA, sous réserve du respect des conditions légales applicables.
The applicable VAT regime is the one in force on the date of invoicing. Any change of regime or of statutory rate applies as of right to services not yet invoiced.
5.2 What the price covers
The price covers only the services and deliverables listed in the quote. The following are not included, unless expressly stated:
- travel outside the area agreed in the quote
- the purchase of licences for fonts, images, music or third-party software
- hosting, domain name and recurring third-party service fees
- printing, manufacturing and delivery of physical items
- hire of equipment specific to a production
- third-party services ordered on the client's behalf
These items are quoted separately and require written approval before any commitment is made.
6. Payment
6.1 Schedule
Unless the quote states otherwise: 50% on acceptance, the balance on final delivery. Monthly support plans are charged on the agreed date, until cancellation.
6.2 Means of payment
Bank transfer, card through Stripe, cheque, and cash within the statutory limit of €1,000 (article L112-6 of the French Monetary and Financial Code).
Card payment takes place on Stripe's secure page: no bank details pass through this site, nor are any stored here.
6.3 Due date
Invoices are payable on receipt, unless a period is agreed in writing, which may not exceed the statutory maximums (article L441-10 of the French Commercial Code).
6.4 Late payment
Any delay gives rise as of right, with no prior formal notice, to penalties calculated at the European Central Bank's interest rate plus 10 percentage points, together with a fixed indemnity of €40 for recovery costs. Additional compensation may be claimed on production of evidence if the actual costs exceed that fixed sum.
Work in progress may be suspended until the situation is resolved, without that suspension giving rise to any compensation or extending the deadlines.
7. Performance of the services
7.1 The provider's obligations
MEUS PRODUCTION undertakes to carry out the work with care and in accordance with professional standards, to inform the client of any difficulty likely to affect the project, and to respect the confidentiality of the information entrusted to it.
This is an obligation of means: creative work being by nature a matter of judgement, no commercial result, audience figure or measured performance is guaranteed, unless expressly undertaken in writing.
7.2 The client's obligations
Proper performance assumes the client's active cooperation. The client undertakes to:
- provide a clear brief and all the necessary material: copy, images, logos, technical access
- appoint a single contact authorised to approve work
- respond to approval requests within the agreed time
- warrant that it holds the rights to everything it supplies, and indemnify MEUS PRODUCTION against any third-party claim in that respect
- pay the sums due on the agreed dates
7.3 Approval of deliverables
The client has 7 working days to approve each interim deliverable or to send comments. Without a response within that time, the deliverable is deemed accepted and the project continues on that basis.
8. Deadlines
The deadlines shown in the quote are indicative. They run from confirmation of the order and receipt of all the necessary material.
They depend in particular on:
- the nature and scale of the work
- how quickly the client supplies the material
- the approval times at each stage
- requests for changes made during the project
- constraints specific to filming: weather, permits, availability of locations and of the people involved
A delay attributable to the client shifts the schedule accordingly, with no penalty for the provider. An overrun cannot give rise to cancellation, withholding or compensation, except in the case of established gross negligence.
9. Changes and revisions
9.1 Revisions included
Unless the quote says otherwise, two rounds of changes are included per deliverable. A round is a set of comments sent in one go.
9.2 Additional changes
Beyond that, revisions are charged for the time spent, at the hourly rate set out in the quote, after informing the client and obtaining their prior agreement.
9.3 Change of scope
Any request falling outside the initial scope - a new creative direction, an additional deliverable, a redesign after approval - constitutes new work. It is the subject of an additional quote and only starts once accepted in writing.
10. Cancellation and postponement
10.1 Cancellation by the client
The client may end the project at any time, in writing. The work already carried out at the date of cancellation then falls due, together with the costs irrevocably incurred on the client's behalf - licences acquired, equipment reserved, third-party services ordered. The deposit paid is set against those sums; any balance is refunded.
10.2 Postponing a dated booking
For work requiring a reserved date - filming, a photo shoot, event coverage - a postponement requested less than 7 days before the agreed date may lead to the costs incurred and the day held being invoiced, where no other assignment could be scheduled.
A postponement is offered free of charge where the impediment results from force majeure within the meaning of article 14.
10.3 Cancellation by the provider
Where performance becomes impossible, sums paid in respect of work not carried out are refunded to the client in full.
10.4 Consumer right of withdrawal
A consumer client has 14 days from the conclusion of the distance contract to withdraw, without giving reasons and without penalty (articles L221-18 et seq. of the French Consumer Code).
That right does not apply to:
- services fully performed before the end of the period, with the consumer's prior express agreement and acknowledged waiver
- goods or creations personalised to the consumer's specifications
- downloadable digital resources to which immediate access was requested, the consumer acknowledging the loss of the right of withdrawal as soon as the download begins (article L221-28, 13°)
Each file purchased remains downloadable 5 times for 30 days from the client portal.
11. Intellectual property
This article matters: it distinguishes what is owned from what may be used.
11.1 Ownership of rights
Under the French Intellectual Property Code, the author of a work is its original owner. MEUS PRODUCTION therefore remains the owner of the rights in its creations - graphic, photographic, audiovisual, editorial and software - until they are expressly assigned.
The author's moral rights cannot be assigned: the right of attribution and the right to the integrity of the work survive whatever the extent of the assignment.
11.2 Assignment of economic rights
No assignment is automatic. The extent of the rights assigned is defined in the quote, which specifies, in accordance with article L131-3 of the French Intellectual Property Code:
- the rights assigned: reproduction, communication to the public, adaptation
- the media and uses permitted
- the geographical scope
- the duration
The assignment only takes effect on payment in full of the agreed price. Until then, no exploitation is permitted.
11.3 Right of use where there is no assignment
Where the quote does not provide for an assignment, the client has a non-exclusive, non-transferable right of use, limited to the uses described in it. Any exploitation beyond that - a new medium, a new territory, resale, sub-licensing - requires written agreement and may give rise to additional payment.
11.4 Source files
Source files - working design files, video rushes, edit projects, source code - are not included by default. They may be handed over where the quote provides for it, after payment in full. Failing that, only the final deliverables in the agreed formats are supplied.
Where source files are handed over, no technical dependency on the provider is imposed on the client.
11.5 Third-party elements
Fonts, stock images, music, excerpts and software components incorporated into a creation remain subject to their owner's licence. The client is informed in the quote of their presence, their cost and the limits on their use. Those licences cannot be assigned beyond what their owner permits.
11.6 Material supplied by the client
The client warrants that it holds the rights to everything it supplies - logo, copy, photograph, trade mark, database - and indemnifies MEUS PRODUCTION against any third-party claim in that respect.
12. Portfolio and communication
MEUS PRODUCTION would like to be able to present completed projects in its portfolio, on its site and in its professional communication.
That use is subject to the client's agreement, obtained in the quote or in writing on delivery. It is never presumed.
Agreement once given may be withdrawn at any time, by a simple written request: the work is then removed from online material as promptly as possible.
Enhanced confidentiality may be agreed from the quote onwards, in particular for a project not yet made public, a launch under embargo, or strategic material. Nothing is then published, not even in part.
Client testimonials published on this site appear with their authors' prior agreement, and are removed on request.
13. Liability
MEUS PRODUCTION is liable under the general law for direct damage resulting from a breach of its obligations.
It cannot, however, be held liable for the consequences of matters beyond its control:
- the inaccuracy or unlawfulness of material supplied by the client
- use made of the deliverables beyond the rights granted
- commercial performance, audience or search rankings achieved
- the failure of a third-party service: hosting, social network, payment platform
- loss of data that the client failed to back up after delivery
No clause limits the liability that the law forbids excluding: personal injury, gross or wilful misconduct, the statutory guarantee of conformity and the guarantee against hidden defects owed to consumers, and any provision of public policy.
As regards professional clients, and other than in the cases above, compensation for direct damage is capped at the amount actually paid, excluding VAT, for the work concerned.
14. Force majeure
Neither party can be held liable for a failure resulting from force majeure within the meaning of article 1218 of the French Civil Code: an event beyond its control, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures.
The party prevented informs the other without delay. The obligations affected are suspended for the duration of the impediment, and a new schedule is agreed in good faith.
If the impediment continues beyond two months, either party may end the contract in writing. Work carried out and costs incurred remain payable; the remainder is refunded.
15. Personal data
Personal data collected in connection with an order is processed in order to perform the contract, to invoice, and to meet accounting obligations.
The detail - data collected, purposes, legal bases, recipients, retention periods, and how to exercise your rights of access, rectification, erasure, restriction, objection and portability - is set out in our privacy policy.
Each party undertakes to comply with the applicable regulations for the personal data it accesses in connection with the project.
17. Governing law
These Terms and the contracts they govern are subject to French law, wherever the work is performed and whatever the client's country of residence.
They are drawn up in French. Where a translation is provided, only the French version is authoritative.
Should any provision be held void or unenforceable, the others retain their full effect.
18. Disputes and mediation
18.1 Amicable resolution
Should a difficulty arise, the parties undertake to come together to seek an amicable solution before taking any action. Any complaint may be sent to contact@meusproduction.org.
18.2 Consumer mediation
In accordance with article L612-1 of the French Consumer Code, a consumer client may use a consumer mediator free of charge to resolve a dispute amicably, after first trying to settle it directly with us.
The details of the competent mediator will be provided once formally appointed.
The European Online Dispute Resolution platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228.
18.3 Jurisdiction
Failing an amicable resolution, the dispute is brought before the competent French courts.
Consumer clients: in accordance with article R631-3 of the French Consumer Code and article 46 of the French Code of Civil Procedure, a consumer may choose to bring proceedings before the court of their place of residence, that of the place where the service was performed, or that of the provider's registered office. No provision of these Terms restricts that choice.
Professional clients: jurisdiction is conferred on the courts of Nîmes, France, notwithstanding multiple defendants or third-party proceedings.
19. Updates to these Terms
These Terms may be amended at any time. The version applicable to an order is the one in force on the date the quote is accepted; a later amendment has no effect on orders already confirmed.
It is advisable to read this page before each new order. The legal notice completes this document.
